Terms of Service for ScamScan by Guardianly

Agreement to Terms

By accessing or using the ScamScan web application operated by Guardianly, Inc. ("ScamScan," "Service," "Guardianly," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

Service Availability: ScamScan is currently available worldwide through our web application at scamscan.guardianly.ai.

Description of Service

ScamScan is a web-based scam detection service that provides:

• Image analysis for detecting scams in screenshots, photos of messages, emails, and other visual content
• Text content analysis for emails, SMS messages, URLs, and other written communications
• AI-powered scam detection and analysis
• Instant scam verdicts (Scam Likely / Scam Unlikely) with detailed analysis
• Educational content about scam tactics, red flags, and protection strategies
• Real-world scam example videos through curated YouTube recommendations
• Conversation history and management (for registered users)
• Anonymous usage with limited monthly scans (5 scans/month for non-registered users)
• Extended usage with Google account registration (30 scans/month for registered users)

Eligibility

You must be at least 13 years old to create a registered account. Anonymous users may use the Service at any age with appropriate parental supervision for users under 13. By using ScamScan, you represent and warrant that:

• You are at least 13 years old if creating a registered account (Google account required), OR
• You are using the Service anonymously with parental/guardian supervision if under 13
• You have the legal capacity to enter into these Terms (or have parental consent if under 18)

If you are a parent or guardian permitting a child under 13 to use this Service anonymously, you agree to be bound by these Terms and are responsible for their use of the Service.

Account and Registration

Account Types

Anonymous Users:

• No account registration required
• Limited to 5 scans per month per device
• Usage tracked via browser-based device fingerprint
• Conversations automatically deleted after 90 days of inactivity
• No conversation history synchronization across devices
• Cannot recover conversations after closing browser

Registered Users:

• Account registration via Google OAuth authentication
• Extended usage quota: 30 scans per month
• Persistent conversation history across devices and sessions
• Ability to delete individual conversations or entire account
• You are responsible for maintaining the security of your Google account
• You agree to provide accurate and complete information during registration
• You are responsible for all activities that occur under your account

Acceptable Use

You agree to use ScamScan only for lawful purposes and in accordance with these Terms. You agree NOT to:

Prohibited Activities

• Use the Service for illegal activities or to facilitate illegal activities
• Upload content that you do not have permission to upload or analyze
• Upload inappropriate, illegal, harmful, or private content (including personal information of others without consent)
• Upload child sexual abuse material (CSAM) or any content depicting minors in inappropriate contexts
• Attempt to bypass, disable, or interfere with security features, rate limits, or usage quotas
• Reverse engineer, decompile, or disassemble the Service
• Transmit malware, viruses, or harmful code
• Violate any applicable laws or regulations
• Impersonate others or provide false information
• Abuse or overload our AI services or attempt to manipulate AI-generated content
• Use automated systems (bots, scrapers) to access the Service without authorization
• Attempt to circumvent device fingerprinting or quota tracking systems
• Share registered account credentials or allow unauthorized access to your account
• Use the Service to violate the privacy, intellectual property rights, or other rights of third parties
• Harvest or collect information about other users
• Use the Service to create, train, or improve competing AI or scam detection services

Content Responsibility

You are solely responsible for:

• Ensuring you have the legal right to upload and analyze content
• Complying with copyright, privacy, and other laws when submitting content
• The accuracy and legality of content you submit
• Any consequences resulting from content you upload

Privacy and Data Collection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using ScamScan, you consent to our data practices as described in the Privacy Policy.

Key Privacy Points

• We collect device fingerprints for anonymous users and Google account information for registered users
• Uploaded images and text content are stored on our Google Cloud Storage servers
• All uploaded content is processed through third-party AI services for scam analysis
• Images are retained with conversations until deleted (registered users) or after 90 days of inactivity (anonymous users)
• Conversations are stored until deletion (registered users) or for 90 days of inactivity (anonymous users)
• We do not sell your personal information to third parties
• We do not use third-party advertising or tracking cookies

Scam Detection and AI Services

How It Works

• ScamScan uses third-party AI services to analyze uploaded images and text content
• The AI examines visual elements, text patterns, suspicious indicators, and known scam tactics
• Analysis results include a verdict (Scam Likely / Scam Unlikely), confidence level, and detailed explanation
• Educational content explains scam tactics, red flags, and protection strategies
• Video recommendations provide real-world examples of similar scams
• All content you submit is sent to third-party AI services for processing
• Processing happens in real-time and results are returned immediately

Limitations and Disclaimers

• NOT 100% ACCURATE: ScamScan analysis is NOT guaranteed to be accurate and may produce false positives or false negatives
• ADVISORY ONLY: Verdicts and analysis are advisory only and should NOT be your sole basis for decision-making
• USE YOUR JUDGMENT: You should use your own judgment when evaluating potential scams
• NO LIABILITY: We are not liable for undetected scams, incorrectly flagged legitimate content, or decisions you make based on analysis results
• AI LIMITATIONS: AI-generated content may contain errors, inaccuracies, or hallucinations
• EVOLVING SCAMS: Scammers constantly develop new tactics that may not be detected
• THIRD-PARTY SERVICE: Third-party AI services have their own terms, limitations, and privacy policies
• NO GUARANTEE: We do not guarantee protection from scams or fraud

User Content and Intellectual Property

Your Content

• You retain ownership of all images and text content you upload to ScamScan
• By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to:
  • Store, process, and analyze your content to provide the Service
  • Send your content to third-party AI services for analysis
  • Use aggregated, anonymized data for service improvement and research
  • Display your content back to you in the conversation interface
• This license terminates when you delete your content or account
• You represent and warrant that you have all necessary rights to upload and analyze the content
• You agree not to upload content that violates any third-party intellectual property rights

Our Intellectual Property

• ScamScan, Guardianly, and all related trademarks are our property
• The Service, its design, functionality, and content are protected by copyright and other intellectual property laws
• We retain all rights not expressly granted to you in these Terms
• You may not copy, modify, distribute, or create derivative works based on our Service

Your License to Use ScamScan

• We grant you a limited, non-exclusive, non-transferable, revocable license to use ScamScan
• This license is subject to your compliance with these Terms
• We may revoke this license at any time for any reason

Usage Quotas and Limits

Current Quotas

• Anonymous users: 5 scans per month per device
• Registered users: 30 scans per month
• Quotas reset monthly based on your first usage date
• We reserve the right to adjust quotas with appropriate notice

Fair Use Policy

• The Service is intended for personal, non-commercial use
• Excessive or abusive usage may result in service restrictions
• Automated or bulk usage is prohibited without our written permission
• We may throttle, limit, or suspend access for users who abuse the Service

Third-Party Services

Google Services

ScamScan integrates with several Google services:

• Google Cloud Platform: Provides infrastructure for data storage, processing, and service hosting
• Google AI (Gemini): Processes all uploaded images and text content for scam analysis
• Google OAuth: Handles authentication for registered users
• Google Cloud Storage: Stores uploaded images with 30-day lifecycle policies

Educational Video Content

• ScamScan may recommend educational YouTube videos from the Guardianly channel
• These videos provide real-world examples and explanations of scam tactics
• Videos are hosted on YouTube and subject to YouTube's terms of service and privacy policy

Our Responsibility for Third-Party Services

• We are not responsible for third-party service interruptions, outages, or quality issues
• We are not responsible for how third parties process or handle your data
• We are not liable for changes to third-party services that affect ScamScan functionality
• Third-party services may have different privacy practices and data handling policies

Fees and Payment

Current Pricing: ScamScan is currently offered as a FREE service with no subscription fees or payment required.

Future Changes: We reserve the right to:

• Introduce paid subscription tiers or premium features in the future
• Adjust usage quotas for free users
• Offer paid plans with higher quotas or additional features
• Provide at least 30 days notice via prominent website banner before implementing any charges for currently free features

Service Availability and Modifications

Service Availability

• ScamScan requires internet connectivity to function
• We do not guarantee uninterrupted or error-free service
• Service may be temporarily unavailable due to maintenance, updates, or technical issues
• Service quality depends on your internet connection and device
• Third-party service outages (Google Cloud, Google AI) may affect ScamScan availability

Service Modifications

• We may modify, update, or discontinue features at any time
• We may update our AI models, detection algorithms, and analysis methods
• We will provide reasonable notice for material changes that significantly affect functionality
• Your continued use after changes constitutes acceptance of modifications

Disclaimers and Limitations

Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties of uninterrupted, secure, or error-free service
• Warranties regarding the accuracy, reliability, or completeness of scam detection analysis
• Warranties that the Service will detect all scams or accurately identify all legitimate content
• Warranties regarding third-party AI service quality, availability, or accuracy

Scam Detection Disclaimer

IMPORTANT: ScamScan is an educational and advisory tool, NOT a comprehensive fraud prevention system. You acknowledge and agree that:

• ScamScan may miss scams (false negatives)
• ScamScan may incorrectly flag legitimate content as scams (false positives)
• AI analysis can be wrong, incomplete, or misleading
• You should NOT rely solely on ScamScan for making important decisions
• You should use your own judgment and verify suspicious content through other means
• ScamScan is NOT a substitute for professional legal, financial, or security advice

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUARDIANLY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, business opportunities, or goodwill
• Damages resulting from service interruptions, errors, or unavailability
• Damages from third-party service failures (Google Cloud, Google AI, etc.)
• Damages from undetected scams, fraud, or malicious content
• Damages from false positive scam detections or incorrect analysis
• Inaccurate, incomplete, or misleading AI-generated analysis or recommendations
• Privacy or security breaches involving third-party services
• Loss or deletion of uploaded images, conversation history, or other data
• Decisions you make based on ScamScan analysis or recommendations
• Financial losses, identity theft, or fraud resulting from scams not detected by the Service
• Issues related to content you upload, including copyright violations or privacy violations
• Unauthorized access to your account or data due to compromised credentials

MAXIMUM LIABILITY: OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED $100 USD, OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (CURRENTLY $0 FOR FREE SERVICE), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Guardianly, Inc., its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property, privacy, or other proprietary rights
• Your violation of any applicable laws or regulations
• Content you upload or submit to the Service
• Decisions you make based on ScamScan analysis or recommendations
• Your failure to detect scams using the Service
• Any false or misleading information you provide

Termination

Your Rights

• You may stop using ScamScan at any time without notice
• Registered users may request account deletion by contacting support@guardianly.ai
• Account deletion requests are processed within 30 days
• Deleted accounts cannot be recovered - all conversation history and personal data will be permanently removed
• To prevent abuse, you cannot create a new account with the same email for 90 days after deletion

Our Rights

We may terminate, suspend, or restrict your access to ScamScan immediately, with or without notice, if:

• You violate these Terms or our Privacy Policy
• You engage in prohibited activities or abuse the Service
• You exceed usage quotas through circumvention or abuse
• We suspect fraudulent, illegal, or harmful activity
• Required by law or legal process
• We decide to discontinue the Service
• For any other reason at our sole discretion

Effect of Termination

• Your right to use the Service ends immediately upon termination
• We may delete your account, conversation history, and uploaded content
• You remain responsible for any obligations incurred before termination
• Provisions of these Terms that should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect
• Termination does not affect any rights or obligations that accrued before termination

Geographic Availability and Legal Compliance

• ScamScan is available worldwide but may be restricted in certain jurisdictions
• You are responsible for compliance with your local, state, national, and international laws
• Some features may be restricted or unavailable based on your location
• We may block access from certain countries or regions at our discretion
• You represent that your use of ScamScan does not violate any laws applicable to you

Changes to Terms

We may modify these Terms at any time. When we make changes, we will:

• Post the updated Terms on the ScamScan website
• Update the "Last Updated" date at the top of this document
• For material changes: Display a prominent notice on the website
• For registered users with material changes: Send email notification when possible
• For significant changes: Provide at least 30 days notice via website banner before the changes take effect

Your continued use of ScamScan after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

Note for Anonymous Users: Since we do not collect contact information from anonymous users, you are responsible for periodically reviewing these Terms. Material changes will be prominently displayed on the website.

Governing Law and Disputes

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Dispute Resolution

Informal Resolution: Before filing any legal claim, you agree to contact us at support@guardianly.ai to attempt to resolve the dispute informally. We will attempt to resolve disputes through good-faith negotiation.

Jurisdiction: Any legal action or proceeding arising from or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Delaware, United States. You consent to the personal jurisdiction of these courts.

Class Action Waiver

IMPORTANT: TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN COURT OR ARBITRATION, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Guardianly.

Limitation Period

You agree that any claim arising from or relating to these Terms or the Service must be filed within one (1) year after the claim arose. Claims filed after this period are permanently barred.

General Provisions

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Guardianly.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms or our rights without restriction, including in connection with a merger, acquisition, or sale of assets.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Guardianly regarding the Service and supersede all prior or contemporaneous communications, agreements, or understandings, whether written or oral.

No Agency

No agency, partnership, joint venture, or employment relationship is created between you and Guardianly as a result of these Terms or your use of the Service.

Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Export Control

You agree to comply with all applicable export and import control laws and regulations in your use of ScamScan. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
